In June 2006, the Police Powers and Responsibilities Act 2000 (Qld) was amended to make move-on powers available to the police in all public places statewide (s. 44).1 The legislation also required the Crime and Misconduct Commission (CMC) to review the use of these powers after an initial period of implementation (s. 49).

In 2008, the CMC sought public comment on these move-on powers. This paper explains the current powers, their history, the nature of the review, and how to provide comments.

Submissions from the public were sought in relation to the following questions:

  1. How are the evade police provisions being used by police?
  2. How are evade police offences being dealt with by the courts?
  3. What impact have the evade police provisions had on the number of police pursuits?
  4. Are the evade police provisions a useful operational tool for investigating and prosecuting offenders?

Update: Submissions can be found below.

Submissions to our review of Queensland's police move-on powers

As a general rule, we have tried to publish all written submissions unedited and in full. However, some submissions from private citizens have not been published or have been edited to remove personal details or other information at the request of the author or upon legal advice.

Thank you to everyone who provided a submission to our review. Our call for public comment has provided us with valuable information that constitutes an important part of our review process.
