The Crime and Corruption Commission (CCC) is reviewing Queensland’s Terrorism (Preventative Detention) Act 2005 (TPDA).
The CCC is calling for public submissions.
Section 83(A) of the TPDA requires the legislation to be reviewed. The Minister for Police and Minister for Corrective Services has approved the CCC to conduct the review due to its independent research capacity and experience in conducting similar legislative reviews.
The TPDA enables a person to be detained by police for a short period of time to prevent a terrorist act from occurring in the near future. It also enables evidence to be preserved that may be linked to a terrorist act.
The TPDA has been in operation since 2005 but has never been used.
Some of the questions the CCC’s review is considering include:
- the overall need for and effectiveness of the TPDA;
- requirements for making preventative detention orders;
- police questioning powers and
- safeguards against any potential abuse of the legislation.
The deadline for public submissions is Thursday 29 March 2018.
A report based on submissions and the CCC’s review will be provided to the Minister and is expected to be tabled in State Parliament in November 2018.
