The Crime and Misconduct Commission has examined allegations of electoral rorting in the Australian Labor Party (ALP) and has concluded that the matter does not fall under the CMC’s jurisdiction.

Allegations were made that Mr Russell Carr was improperly registered to vote in an ALP federal preselection ballot, due to his residency at the time.

The CMC was asked to investigate possible official misconduct by Minister for the Environment and Multiculturalism Lindy Nelson-Carr, on the basis that she would have had knowledge of her husband’s alleged activities.

The CMC does not have any function in relation to ALP preselection rules and processes. Its jurisdiction could only be invoked for an alleged offence against the Electoral Act 1992.

The CMC made inquiries and found no reasonable suspicion of official misconduct by the minister or Mr Carr.

The CMC will not be taking any further action.
