The Crime and Corruption Commission (CCC) has determined it will examine whether it is in the public interest for allegations of corrupt conduct to be publicised, and if not, what legislative and other options are available to prevent it.
The CCC published a discussion paper today titled Making allegations of corrupt conduct public: Is it in the public interest? and is calling for public submissions to support the examination of this issue.
Publicising allegations of corrupt conduct may adversely affect the ability of the CCC to perform its corruption function, damage the reputation of the person alleged to have engaged in corrupt conduct and could compromise the fair trial of persons charged with criminal offences.
However, identifying a potential solution that ensures allegations of corrupt conduct remain confidential whilst they are being investigated must be balanced against the right to freedom of speech, the right of the media to report matters of public interest and the need for open and accountable government.
CCC Chairman Alan MacSporran QC said to support the examination of this issue, the CCC is calling for public submissions and will convene a public forum later this year to canvass the arguments raised.
“Publicly discussing this issue and hearing from a cross-section of the community may help to identify a workable solution to avoid reputational damage and any detrimental impacts on our investigations while also balancing the protection of free speech,” Mr MacSporran said.
“The CCC appreciates this is a complex issue and believes it is best explored in an open and transparent manner. The CCC values the views of all interested parties and invites submissions on this issue so they can be fully considered.”
Submissions are due by 5.00pm on 30 June 2016. The discussion paper and instructions on how to make submissions are available on the CCC’s website.
CCC Chairman Alan MacSporran QC will hold a press conference today at 12.00pm to discuss the examination of this issue.
