The Crime and Corruption Commission (CCC) has determined it is in the public interest to provide an update on the assessment of matters raised in a self-referral from the Director-General of Premier and Cabinet and how it relates to the review of private emails belonging to the Honourable Mark Bailey MP.
Based on information before the CCC, the CCC has determined the matters contained in the self-referral from the Director-General of Premier and Cabinet do not raise a reasonable suspicion of corrupt conduct and will therefore take no further action at this time.
In relation to the CCC’s direction to the Director-General to work collaboratively with the State Archivist to review the contents of the private email account belonging to the Honourable Mark Bailey MP, the CCC is of the view the self-referral does not raise an actual conflict of interest. However, the CCC acknowledges there is a perception of a conflict of interest.
Another senior officer within the Department of Premier and Cabinet will now conduct the review in collaboration with the State Archivist.
The CCC’s direction to the Department of Premier and Cabinet to work collaboratively with the State Archivist remains in place and the report is still required to be completed by 15 June 2017.
As previously outlined, the review will assist in determining if any criminal offences may have been committed, including a breach of the Public Records Act 2002.
The CCC will determine whether to investigate this matter following the review of the emails by the State Archivist and the senior officer from the Department of Premier and Cabinet.
The CCC will continue to monitor the review.
