Public servant to appear in court over alleged kickbacks totalling $130K — 12.05.2014

A Crime and Misconduct Commission (CMC) investigation has led to a public servant facing 59 charges for allegedly receiving more than $130,000 in secret commissions. 

A 55-year-old man from Reedy Creek is scheduled to appear in the Southport Magistrates Court today.

The CMC last month served him with a Notice to Appear in court on 59 charges of receiving secret commissions contrary to Section 442B(a) of the Criminal Code.

The 55-year-old man was a senior procurement manager at a facility on the Gold Coast operated by the former Department of Innovation, Information, Economy, Sport and Recreation. The CMC will allege the man requested and received fees from contractors over an extended period of time for undertaking aspects of those contractors’ invoicing to the Department.

The CMC’s investigation identified 59 separate payments totalling $133,664.45 were allegedly made from contractors to the public servant.  

As part of the same CMC investigation, a cleaning, maintenance and security contractor was charged with fraud in May 2013. The 49-year-old man from Slacks Creek appeared on 7 March 2014 before the Brisbane District Court and was sentenced to 18 months imprisonment wholly suspended for two years.

In addition, the 49-year-old man was ordered to pay $18,345.90 in restitution to the Department of National Parks, Recreation, Sport and Racing.
