No criminal charges against former Director-General — 04.12.2013

On advice from the Director of Public Prosecutions (DPP), the Crime and Misconduct Commission (CMC) has determined that it will not lay criminal charges against the former Director-General of the Department of Transport and Main Roads, Mr Michael Caltabiano.

In September 2012, the CMC commenced a misconduct investigation into the process surrounding the appointment of a departmental officer, after receiving information alleging official misconduct in relation to the process.

In July 2013, the CMC referred a brief of evidence relating to Mr Caltabiano to the DPP.

Last week, the DPP advised the CMC that any prosecution of Mr Caltabiano for alleged criminal offences would not have reasonable prospects of success, and, in those circumstances, criminal charges against Mr Caltabiano were not warranted.

As such, the CMC will not take any further action in relation to Mr Caltabiano.
