Abuse of Office charge withdrawn — 28.10.2014

The Crime and Corruption Commission (CCC) can confirm one charge of Abuse of Office relating to a police officer was withdrawn today in the Brisbane Magistrates Court.

The Crime and Misconduct Commission (CMC) sent a brief of evidence to the Office of the Director of Public Prosecutions (ODPP) seeking advice on whether a charge against a serving police officer for Abuse of Office, contrary to Section 92 of the Queensland Criminal Code was warranted.

The CMC acted upon advice from the ODPP and on 15 May 2014 a Detective Sergeant from the South Eastern Region was issued with a Notice to Appear in Court on one charge of Abuse of Office.

The Crime and Corruption Commission (CCC) received further advice from the ODPP last week (24 October 2014) that there was not a reasonable prospect of a conviction.

The charge was withdrawn this morning when the matter was before the Brisbane Magistrates Court.

The matter is now closed and the CCC will take no further action criminally.
